U.S. Crypto Regulatory Update: New Life for RFIA Negotiations? The U.S. crypto regulatory environment shifted from full legislative deadlock to an aggressive bureaucratic sprint this week. While Congress remains mired in the longest (full) government shutdown in a generation—temporarily halting even formerly bipartisan issues, like the long-awaited Market Structure Bill —top regulators and the Federal Reserve are picking up the slack. This week saw a high-stakes emergency meeting between industry leaders and lawmakers in an attempt to salvage the legislative path, even as the SEC and CFTC announced an ambitious new deadline for final rules. New Hopes for the Market Structure Bill Leading figures from several of the most prominent crypto firms—including the CEO of Coinbase — met separately with groups of Democratic and Republican Senators on Wednesday in a high-stakes effort to jumpstart stalled negotiations on comprehensive market structure legislation. CEOs of several of the leading crypto firms met with Democrats on Wednesday. The purpose of the meetings was to overcome deep-seated political tensions and provide industry input following the recent deadlock over the bipartisan Responsible Financial Innovation Act (RFIA). Meetings with Democrats: Executives expressed encouragement from the forward-looking mindset of key Senators, particularly among Democrats who, despite lingering frustrations over a recent proposal leak, indicated a strong desire to pass a bill this year. The Legislative Outlook: The path remains exceptionally narrow due to the government shutdown, the looming November appropriations deadline, and significant policy differences, particularly concerning the regulation of Decentralized Finance (DeFi). The industry left Capitol Hill with a mixed message: while there is political will, the calendar and partisan rancor are the biggest remaining obstacles. As we get closer to mid-term elections, it looks like Crypto Political Action Committees (PACs) will add additional pressure to candidates they supported in the 2024 General election. SEC & CFTC Want Final Rules by EOY The U.S. financial regulatory landscape continues its dramatic shift toward a clearer, pro-innovation framework, with both the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) signaling an aggressive timeline for final rules. Following a landmark Joint Statement on Agency Harmonization and a joint roundtable in late September, both agencies are working to harmonize their approach. CFTC Tweeted that they want Crypto rules by EOY. CFTC Acting Chair Caroline Pham has echoed sentiment for a rapid finish. SEC Atkins echoed sentiment on Wednesday. SEC Chair Paul Atkins publicly stated this week that the agencies are committed to providing the markets the clarity they deserve, including a goal of having the most critical crypto-related rules finalized by the End of Year (EOY). Focus Areas: The upcoming rules are expected to focus on streamlined reporting standards, coordinated innovation exemptions, and harmonizing product definitions, signaling an end to the era of regulation-by-enforcement. Waller Statements at Fed Round Table Federal Reserve Governor Christopher Waller delivered a highly-watched opening statement at the Fed's recent Payments Innovation Conference, declaring, “This is a new era for the Federal Reserve in the payments sector. The DeFi industry is no longer viewed with suspicion or ridicule.” His comments officially welcomed the digital asset industry to the conversation on the future of U.S. payments. Fed held a Crypto Roundtable. The most significant proposal from the event was Waller’s call for the Federal Reserve to study and potentially implement a "streamlined master account"—or what he nicknamed a "skinny master account"—for payment-focused non-bank financial institutions, including stablecoin issuers and crypto payment companies. The Impact of the “Skinny Master Account”: This new account concept would provide direct access to the Fed’s payment systems (like Fedwire and FedNow) but would be limited in function. This is a monumental shift, as it could drastically reduce costs and improve efficiency for stablecoin issuers by granting direct access to the U.S. central bank payment rails without being forced to rely on intermediary banks. The Executive Pardon: CZ of Binance Granted Clemency In a significant executive action that immediately impacted the crypto industry, President Donald Trump issued a full and unconditional pardon to Binance founder Changpeng "CZ" Zhao on Thursday. CZ had previously pleaded guilty to a felony charge of failing to maintain an effective anti-money laundering program at the world's largest crypto exchange. The Clemency: The White House announced that the President exercised his constitutional authority to issue the pardon, a move that wipes CZ's criminal record clean. Policy Signal: The action is being viewed as the administration's strongest signal yet of its commitment to ending perceived punitive action against the crypto industry, with the White House stating the previous prosecution had "severely damaged the United States' reputation as a global leader in technology and innovation." Market Reaction: The pardon immediately injected bullish momentum into the markets, specifically causing a notable price jump in the Binance Coin (BNB), and is expected to reinforce confidence in the administration's broader pro-crypto policy agenda.
